DEP Fines Atlas Resourcs for Drilling Wastewater Spill in Washington County

- The state's Department of Environmental Protection has fined a natural gas drilling company nearly $100,000 for a wastewater spill that contaminated a southwestern Pennsylvania watershed.

The DEP on Tuesday announced the $97,350 fine against Atlas Resources. Environmental officials say Atlas allowed hydraulic fracturing fluids used to drill in the Marcellus Shale to overfill a wastewater pit and contaminate a tributary of Dunkle Run in Washington County.

DEP officials say the spill happened in early December 2009. Environmental officials say Atlas corrected the problem but failed to report it to the DEP.

Atlas Energy says the spill had no negative environmental consequences and the company has stepped up monitoring in response.

As water worries mount, researcher says Marcellus Shale poses risk to air


Protecting watersheds in the Marcellus Shale region and forcing driller disclosure of fracking chemicals are the foremost demands of those concerned about potential environmental harm from natural gas activity.

The focused attention leaves out potentially greater threats, said Conrad "Dan" Volz, Ph.D., director and principal investigator of University of Pittsburgh's Center for Healthy Environments and Communities. The region's air could face a so far undetected threat, he said.

While a spill at a natural gas drilling site that contaminates water is catastrophic, air pollution can be a more insidious problem - one he said he feels is being overlooked.

While environmental groups and citizens scour lists of chemicals added to hydraulic fracturing fluid used to break up the shale formation, the greater threat may come from toxins that come to the surface as flowback, said Mr. Volz. He said state air-monitoring stations tend to be located in urban areas, away from rural areas where much of the drilling would be taking place.

He said the flowback is a slurry that can contain naturally-occurring benzene, strontium and arsenic. The flowback is often stored in uncovered fracking ponds where volatile organic compounds evaporate into the air. Condenser stations, wells and pipelines also discharge VOCs.

VOCs, both manmade and naturally occurring, are emitted into the air by certain liquids and solids. Some can adversely affect health in cases of chronic exposure, according to the Environmental Protection Agency.

VOCs emitted by a single well pad may not be that significant, and Dr. Volz said there's debate over the risk to air quality and health. But as drilling intensifies, however, air quality will become an issue, he said.

Dr. Volz delivered his comments at a rollout of his group's Marcellus Shale website, www.fractracker.org, to a group of stakeholders that included economic development officials, environmental groups and academics in Danville on Thursday.

He hopes Fractracker.org will help inform policymakers on issues such as where to place permanent air-monitoring stations.

Compounding air quality unknowns is the lack of state Department of Environmental Protection air-monitoring stations in many parts of the Marcellus Shale region. The stations tend to be in urban areas with historically high industrial activity. Stations are in Swiftwater, Peckville, Scranton, Wilkes-Barre and Nanticoke. None are in Wayne, Wyoming, Susquehanna or Bradford counties, where drilling activity is more common.

The DEP has a mobile air-quality lab collecting data around natural gas activity. The data has not been released, said DEP spokesman Mark Carmon. But Mr Carmon said it can provide a snapshot of the impact of natural gas activity on air quality.

Chris Tucker, spokesman for Energy In Depth, an oil and gas producers' association, said open fracking pits are increasingly being replaced by closed loop systems such as one being used by Anadarko Petroleum Corp., reducing the release of VOCs.

He also said that unlike natural gas in Southwestern Pennsylvania, natural gas coming from the Northeast is so- called "dry gas," nearly pure methane, with fewer condensates and VOCs.

University of Scranton chemistry professor Michael C. Cann said thousands of different chemicals come out of the earth in fracking fluid, but without research or testing, it's hard to assess the impact of the process.

"Certainly there are dangerous, naturally-occurring volatile organic compounds, but without research and testing, there's no way to know the risk," Dr. Cann said.

HARRISBURG -- The Department of Agriculture announced today that it has quarantined cattle from a Tioga County farm after a number of cows came into contact with drilling wastewater from a nearby natural gas operation.

Agriculture Secretary Russell Redding said uncertainty over the quantity of wastewater the cattle may have consumed warranted the quarantine in order to protect the public from eating potentially contaminated beef.

“Cattle are drawn to the taste of salty water,” said Redding. “Drilling wastewater has high salinity levels, but it also contains dangerous chemicals and metals. We took this precaution in order to protect the public from consuming any of this potentially contaminated product should it be marketed for human consumption.”

Redding said 28 head of cattle were included in the quarantine, including 16 cows, four heifers and eight calves. Those cattle were out to pasture in late April and early May when a drilling wastewater holding pond on the farm of Don and Carol Johnson leaked, sending the contaminated water into an adjacent field where it created a pool. The Johnsons had noticed some seepage from the pond for as long as two months prior to the leak.

The holding pond was collecting flowback water from the hydraulic fracturing process on a well being drilled by East Resources Inc.

Grass was killed in a roughly 30- x 40-foot area where the wastewater had pooled. Although no cows were seen drinking the wastewater, tracks were found throughout the pool. The wet area extended about 200-300 feet into the pasture.

The cattle had potential access to the pool for a minimum of three days until the gas company placed a snow fence around the pool to restrict access.

Subsequent tests of the wastewater found that it contained chloride, iron, sulfate, barium, magnesium, manganese, potassium, sodium, strontium and calcium.

Redding said the main element of concern is the heavy metal strontium, which can be toxic to humans, especially in growing children. The metal takes a long time to pass through an animal’s system because it is preferentially deposited in bone and released in the body at varying rates, dependent on age, growth status and other factors. Live animal testing was not possible because tissue sampling is required.

The secretary also added that the quarantine will follow the recommended guidelines from the Food Animal Residue Avoidance and Depletion Program, as follows:
• Adult animals: hold from food chain for 6 months.
• Calves exposed in utero: hold from food chain for 8 months.
• Growing calves: hold from food chain for 2 years.

In response to the leak, the Department of Environmental Protection issued a notice of violation to East Resources Inc. and required further sampling and site remediation. DEP is evaluating the final cleanup report and is continuing its investigation of operations at the drilling site, as well as the circumstances surrounding the leaking holding pond.

Wastewater recycling poses risks of odors, leaks and spills

Range Resources dug a pit the size of a football field in the grassy acres just beyond June Chappel's property line last year, yards from the pen where she keeps her beagles and past the trees that shade the porch on her family's small southwestern Pennsylvania home.

Range used it, at first, to store the fresh water needed to produce gas from the seven Marcellus Shale natural gas wells it drilled next door.

But when the company began to fill it with the salt- and metals-laden waste fluids that came back up from the wells, Chappel found odors like that of gasoline and kerosene forced her inside. The rising dew left a greasy film on her windows, she said, and one November day a white dust fell over the yard.

She called the company to complain about the smell and workers came to skim booms across the pit, sopping up odor-causing residue and bacteria.

Throughout all of it, her husband, David, was inside the house, sick with and later dying of cancer at age 54.

"We've gone without," she said in January, standing by the pit with a hood over her head and her beagles nearby in coats. "We don't have a lot here. Now, I feel like it's ruined."

Like the wastewater pits increasingly used by the gas industry in Pennsylvania - the largest of which can hold the equivalent of 22 Olympic-size swimming pools full of contaminated fluid - the problem of what to do with the liquid waste from Marcellus Shale drilling is enormous.

The average Marcellus Shale well requires 4 million gallons of water mixed with sand and chemicals to break apart - or hydraulically fracture - the rock formation and release the gas.

About 1 million gallons of that fluid, now saturated with the salts, metals and naturally occurring radiation that had been trapped in the shale, returns to the surface to be treated, diluted, reused or pumped underground in deep disposal wells.

There has been significant progress in determining what exactly is in the waste and how to reuse it over the last two years - from when the state's environmental regulatory agency belatedly discovered that drillers were sending the fluids to publicly owned sewer systems incapable of treating it, to last week, when the state Independent Regulatory Review Commission endorsed strict restrictions on how much of the waste can be discharged into Pennsylvania's streams.

There has also been a surge in entrepreneurial activity from companies proposing to treat the waste, which can be up to 10 times saltier than sea water.

But even as the state tries to push the stricter treatment standards into law, there are not enough treatment plants in Pennsylvania to remove the salt from the more than a half-million gallons of wastewater that is produced from Marcellus Shale drilling every day.

Those challenges raise what Conrad Dan Volz, director of the Center for Healthy Environments and Communities at the University of Pittsburgh, said is the most obvious of the unanswered questions about the current scale of Marcellus Shale gas production in the state: "Why would we ever start doing this drilling in this kind of intensive way if we didn't have some way to handle and properly dispose of the brine waters?"

Promise and problems with recycling

The problematic pit behind Chappel's home was also part of a pioneering development in the early life of Marcellus Shale gas extraction.

In October, Range Resources was the first company in the commonwealth to claim to be able to reuse all of the waste that flowed back from a well after it was hydraulically fractured. Using the pits, called centralized impoundments, Range discovered that it could dilute Marcellus Shale wastewater with fresh water and reuse it in the next well.

The seemingly simple solution had a dramatic impact: As Range doubled the number of gas wells it drilled between 2008 and 2009, it cut the amount of water it needed to discharge in half because of its reuse program, a spokesman said.

The company shared the information with the other Marcellus operators, and now 60 percent of the wastewater produced in the state is being reused, according to the Marcellus Shale Coalition, a cooperative of the state's Marcellus drillers.

But recycling alone will not cure the industry of a need to dispose of the waste.

In defining the need for strict discharge rules for Marcellus Shale wastewater in April, the Department of Environmental Protection wrote that even with recycling and reuse, "it is clear that the future wastewater return flows and treatment needs will be substantial."

Because the gas development is so new, it is still unclear how much wastewater will be created immediately and over time by the 50,000 new wells that are expected to be drilled in the next two decades.

The waste that flows back slowly and continuously over the 20- to 30-year life of each gas well could produce 27 tons of salt per year, the department wrote. "Multiply this amount by tens of thousands of Marcellus gas wells, and the potential pollutional effects ... are tremendous."

Recycling using centralized pits also has its downsides, from the intrusive to the dangerous:

- Chappel and her neighbors lived with the noxious odors from the pit behind their homes until they hired an attorney and Range agreed to remove it.

- Two of the Marcellus Shale violations for which Range has been cited and fined by the DEP have been for failures of the lines that transfer the waste fluids, sometimes up to seven miles between a wastewater pit and a well site.

- And the potential for the pits to emit chemicals or hazardous elements called volatile organic compounds into the air has been cited in studies in other states and is being monitored by DEP at sites throughout Washington County.

Matt Pitzarella, a Range Resources spokesman, admitted the decision to put the pit behind Chappel's house was "not a good choice" and the company has worked hard to correct it, including removing the pit, reclaiming the hill and even painting Chappel's house.

The company's eight or nine other impoundments in Washington County were built for longer-term use, he said, in areas farther away from people's homes.

Another Range spokesman at an April meeting with neighbors upset about the pit's smells said the impoundments hold "a lot of hydrocarbons," brine, and bacteria "from the water just sitting out there" and that can create odors.

"The warmer it gets, the more putrid it's going to get," he said.

The smell is "not dangerous or harmful. It's annoying."

But complaints of odors from pits helped spur DEP to conduct an air quality study around gas well sites in the region that is expected to be completed this month.

And in its review of the environmental implications of Marcellus Shale gas drilling, New York state determined that the threat posed by the pits may go far beyond annoyance.

An environmental impact statement under review there describes a "worst case scenario" for hazardous air pollutants - especially methanol used by drillers in fracturing fluids and as an antifreeze - escaping from large wastewater impoundments.

According to the report, a centralized impoundment that holds the wastewater from 10 wells could theoretically release 32.5 tons of methanol into the air each year - meaning it could qualify as a "major" source of toxic air pollutants under federal rules.

Because of the risk of leaks and other failures, New York also proposed to ban the use of such centralized impoundments within the boundaries of its most productive aquifers, which underlie about 15 percent of the state.

Broken pipes

The sheer volume of the wastewater and the number of trucks, pits, pipes and people necessary to move it over often long distances, has also increased the probability of leaks and spills, which have already occurred in Pennsylvania. Accidents described in DEP documents reviewed by The Times-Tribune show that the above-ground lines used to pipe the wastewater to and from impoundments and tanks are susceptible to leaks, even when companies take care to prevent them.

In October, an elbow joint came unglued in a PVC line carrying diluted wastewater from one of Range's pits and spilled about 10,500 gallons into a high-quality stream, killing about 170 small fish and salamanders.

According to Range, the company successfully tested the line with fresh water in the week before the wastewater transfer to make sure it could hold the pressure. It was the second transfer line failure for the company in five months.

In a separate incident, a water transfer line used by Chesapeake Appalachia in Bradford County failed five times in five places over five days in December. On one occasion, the pipe burst where it had been weakened from being dragged on the ground. Another time it failed because of a faulty weld, and another because bolts were loose on a valve.

In correspondence with DEP, Chesapeake said it was its policy to transfer only fresh water in its above-ground lines and to use only a more expensive "fused poly pipe" to minimize the risk of spills.

But an estimated 67,000 total gallons of the water did spill and DEP tests of the water found that it was not fresh. Instead, it had elevated levels of salts, barium and strontium - indicators of Marcellus wastewater that the company suspected may have mixed with its fresh water in one of its contractor's tanks, which may have been improperly cleaned between uses.

Brian Grove, Chesapeake's director of corporate development, said the incident did not pose a threat to the public and it did not result in any negative environmental impact. The company has since adopted new procedures for handling, storing and transporting water, he said, and held a meeting with all of its employees and contractors to reiterate its "commitment to safety and environmental stewardship."

Scott Perry, the director of the Department of Environmental Protection's Oil and Gas Bureau, said the above-ground pipelines might be addressed in upcoming revisions to the state's oil and gas regulations, which may also include an evaluation of the construction standards for centralized impoundments and other elements of the industry's handling of wastewater.

The current regulatory standard for the pipelines is that they cannot leak, he said.

"Maybe that's good enough," he said. "There's an absolute prohibition against getting a single drop of it on the ground."

He emphasized that the regulatory agency has to find a way to permit the pipelines so it both protects the environment and encourages their use in order to remove excessive truck traffic from rural roads.

"In a practical sense, if you want to eliminate 100,000 trucks, this is the way to do it," he said.

Radisav Vidic, chairman of the Department of Civil and Environmental Engineering at the University of Pittsburgh, said a better way to minimize the risk of environmental damage is for companies to stop moving the wastewater so much.

Current industry practice for recycling the waste is to fracture a well and then drive or pipe the water to an impoundment or tanks, over and over, he said, "until they move 6 million gallons of water back and forth" to fracture multiple wells on one pad, creating an opportunity for spills with each trip.

Dr. Vidic is studying how to take the wastewater from one well, mix it with acid mine drainage, and use it to fracture subsequent wells on the same multi-well pad - research that is being funded in part by a grant from the U.S. Department of Energy.

He has found that the sulfates in acid mine drainage - one of the biggest sources of pollution in current and former coal mining regions of the state - interact with problem metals like barium and strontium in the wastewater and turn them into solids that can be discarded.

An obstacle to research, though, is how little some gas companies are willing to collaborate, both with him and each other to solve the wastewater problem, he said.

"Every company thinks they know it best, and they keep it to themselves, and they think they're going to get a competitive advantage," he said.

"I'm thinking, who cares? We can all sink together because we're hiding the information, or we can all swim together and everybody's going to get a little bit rich in the process, not filthy rich."

Cabot removes fluids from problem pit

Cabot Oil and Gas Corp. finished removing fluids and sediment from a suspected faulty gas drilling waste pit in Dimock Twp. on Monday, the first in a series of steps the company must take to fulfill a corrective order issued Thursday by the state Department of Environmental Protection.

DEP said liquid waste from the pit at the Hibbard 2H and 4H well sites seeped through tears in the liner into a roadside ditch, a private unused drinking water well, two springs and a wetland.

A regional DEP director also said Cabot had shown "an arrogant disregard" for the environment and the state's regulations by not responding to earlier requests to close the pit.

Cabot spokesman George Stark said the company's tests showed the composition of the fluid in the pit did not match the fluid in the ditch, and Cabot had been working daily with the department on the "science side" of the issue. But the company moved to close the pit "once it became clear that the department would like to see the pit closed."

Two representatives from DEP's oil and gas and environmental cleanup programs were on the Hibbard pad on Monday to oversee Cabot's work. They will inspect and photograph the pit liner before Cabot begins to close and remove the pit later this week, department spokesman Daniel Spadoni said.

Cabot must also submit a plan later this week for determining the extent of contamination in the soil, groundwater and surface water.

Mr. Stark said one of the wells drilled on the Hibbard pad has not yet been hydraulically fractured - the process of breaking apart the gas-bearing rock with water, chemicals and sand that is necessary to produce the gas - but Cabot does not expect the closure of the pit to impact future work on the site.

"Cabot is making every effort to utilize a closed-loop system, where we would not be utilizing a pit moving forward," he said. In a closed-loop system, drilling fluids and waste drawn from a well are piped to closed tanks rather than open earthen pits, which helps to minimize the risk of seeps and overflows.

Mr. Stark said the company is seeking to transition to closed-loop systems at all of its well sites, but a lack of available equipment for the systems makes the switch difficult.

He also said Cabot is continuing an internal investigation into DEP reports that trucks were dumping black fluid into the Hibbard pit on March 17, including identifying which contractor was doing the dumping.

Mr. Spadoni, the DEP spokesman, said the dumping was not necessarily a violation of state drilling regulations.

"It may depend on what was being dumped in there," he said.

WILLIAMSPORT -- The Department of Environmental Protection today ordered Cabot Oil & Gas Corp. to close and remove an earthen pit in Susquehanna County that holds drilling fluids to determine whether it is contaminating nearby water resources.

The pit, known as a reserve pit, is located at the Hibbard well pad in Dimock Township. The company has 14 days to comply with the order.

DEP’s North-central Regional Director Robert Yowell said today’s more aggressive enforcement action was necessitated after the company ignored previous requests.

“DEP strongly advised Cabot to close and remove the reserve pit in an April 8 notice of violation letter and reiterated to Cabot’s senior management the same message a few short days ago,” said Yowell. “However, Cabot has not remedied the situation and its inaction demonstrates an arrogant disregard for Pennsylvania’s oil and gas regulations and proper protection of our environment.”

The department’s Oil and Gas Program staff responded to a report of black water in a ditch near the Hibbard well pad on March 22. The black water had impacted a private unused drinking water well, two springs and a wetland.

The water, soil and sediment sample results from DEP and Cabot’s contractor in the area, along with visible tears and holes in the reserve pit’s liner and local geology, led DEP to conclude that the black water is a mixture of groundwater and liquid waste from the reserve pit.

The DEP order also requires Cabot to submit a site characterization report plan to DEP within seven days; a letter describing the completion of the pit’s final closure and removal within 18 days; and a site characterization report with the results of its investigation and analysis within 45 days.

Radioactivity Rising... Along with Concern

BURDETT, Nov. 13 -- When the state recently tested brine extracted from all 12 of New York’s active Marcellus Shale natural gas wells, several of the samples were highly radioactive.

Six of those tested wells, including the four found to be the most contaminated, are located in Schuyler County.

The tests conducted between October 2008 and April 2009 found that wastewater from the six deep vertical wells in Orange, Dix and Reading showed concentrations of Radium 226 ranging from 60 to 260 times the legal limit for discharge into the environment.

The results could complicate plans for aggressive natural gas drilling locally and lead to calls for more active radiological monitoring throughout the Marcellus Shale drilling region, including Pennsylvania.

“Whatever entity produces those kinds of numbers will have to be licensed by the state,” said Theodore G. Adams, a radiological and environmental consultant in suburban Buffalo. “The waste will have to be managed, treated and disposed of (to avoid human contact).”

Radium 226, which is intensely radioactive, has a half-life of 1602 years and decays into radon gas.

In July, the state Department of Health expressed concerns about the test results in a confidential letter to the Department of Environmental Conservation, which conducted the tests.

Existence of the letter was recently reported by the website ProPublica. DEC confirmed that it received the letter but denied my repeated requests for a copy.

So far, the agency isn’t raising alarms about the test results, saying radioactivity readings can vary widely at any given site.

But if further testing confirms that the readings are roughly accurate indicators of current radioactivity levels, it could significantly drive up the cost of extracting natural gas.

Sites that consistently turn in high radiological readings for their brine would need to obtain special licenses, said Adams, a former federal Department of Energy radiation inspector who runs his own firm that serves clients such as Westinghouse and Alcoa.

Adams noted that wastewater or sludge from such wells would likely require expensive special handling.

Fortuna Energy Inc. of Horseheads operates several of the wells that showed high radioactivity readings, ProPublica has reported. But Mark Scheuerman, Fortuna’s general counsel, declined Friday to confirm or deny the company’s involvement. He said the company planned to address a myriad of drilling issues in written comments to the DEC by yearend.

The DEC conducted extensive radiological tests of New York State natural gas wells in 1999 and found little cause for concern. But none of those were Marcellus wells. In contrast, all of the recent tests were Marcellus wells (six in Schuyler, five in Steuben County and one in Chenango County), and several of them showed much higher readings than any of the 1999 tests.

The results are buried deep in an appendix to the state’s draft Generic Environmental Impact Statement for gas drilling. The charts are presented without any explanation or footnotes.
But the simple numbers speak powerfully, according to Adams.

For example, one well in Orange showed Radium 226 concentrations of 16,030 picocuries per liter. Adams said the state and federal limit for legal discharges into the environment is 60 picocuries per liter.

The legal limit for drinking water is 5 picocuries per liter. The limit for water treated at a sewage treatment plant is 600 picocuries per liter.

Three other Schuyler County wells also showed readings of more than 10,000 picocuries per liter. The highest reading detected outside Schuyler County was 7,885 picocuries per liter at a well in Steuben County. (The findings were reported with uncertainty levels of roughly 25 percent).

All 12 of the tested wells were drilled vertically in the Marcellus Shale, a rock formation several thousand feet below the surface that extends through most of the Southern Tier, Pennsylvania and parts of West Virginia and Ohio.

Although previous public hearings on drilling have touched on a host of environmental issues, radioactivity hasn’t been a prime concern.

Yancey Roy, a spokesman for the DEC, ...said the 12 tested wells were the only active Marcellus Shale wells in the state. And while more radiological testing is needed, he said, that can’t occur until new drilling operations get underway.

Once fracking begins in New York, “decisions will be made, based on the results, as to the proper handling and disposal of waste materials,” he added.

In the past, brine has been used on state roads to help melt snow. (!!!)

An appendix to the proposed DEC drilling rules says: “The modeling showed that the most common method of brine disposal in New York State, spreading it on the roads to control ice and snow, does not present significant (radiation) doses to the public.”

Roy noted that the DEC is concerned about potential buildup of radioactivity in pipes and other drilling equipment and said that equipment may have to be monitored. NORM is also apt to accumulate in sludge that is a byproduct of well wastewater.

More Dead Life

A while ago... September 1st to be exact, I posted about the birds that died while searching for water, mistakenly lured permanently into a gooey sludgepit in South Texas, on or near the McGill Brothers Lease.
ExxonMobil, having just paid a 600,000$ fine for the death of 85 birds in August, apparently hadn't caught up with its negligence.

Not by a long shot it seems, judging from these recent photos.


Once again ExxonMobil STILL looks negligent!

These photos are taken from Mrs. Burns' November 8th post (ExxonMobil -- nature lover), on her great American saga of a blog: A satirical view from the McGill Brothers Lease.

Just a few weeks ago (Oct. 26th), she posted a photo and details of a tractor turned fireball when the driver, a volunteer fire fighter disking fire breaks hit one of XOM's gas lift lines and blew up.
Luckily, he's only 'charred'... but the place reads like a mine field and it's only a matter of time before the next casualty. It certainly doesn't look like there's much remediation going on to prevent it.

How long does this industry imagine it can play the deadly charade too many heedless profiteers, corporate and political alike, are giving a green light?
What will be the ultimate sacrifice that draws their serious, proactive acknowledgement? ...Will we all be dying of thirst? Will it be too late? What's your guess? What are you going to do about it?

Natural Gas Drilling Threatens Communities in Northeastern United States

Natural Gas Drilling is forcing residents in West Virginia to put spikes in the roads to stop drilling trucks from destroying their land, water, and air. In Pennsylvania rural folks are trespassing in order to document toxic natural gas production waste spills. New York City, Washington DC, Philadelphia's drinking water are at risk of contamination.

This week while protesters at the G-20 are getting beaten by police and soaking their bandannas in vinegar to protect their lungs from tear gas,
some folks in neighboring counties and states are putting spikes in roads to stop the drilling trucks, and taking down street signs so that truck drivers can't find their way to drilling sites. Others are documenting ecological devastation, and raising their voices in unison against the officials who purport to protect them.

In Pennsylvania, Ohio, West Virginia, and New York folks struggle with local officials and corporate media, bringing national attention to the victims of peak-energy's destructive frenzy. Numerous incidents involving road accidents, water contamination, and unresponsive government officials have pushed Pittsburgh's neighbors in Wetzel County, West Virginia to place spike strips along RT 89, a road heavily trafficked by Chesapeake Energy's trucks traveling to drilling sites. (1)

"They ruined my life and they've created a new world for you to deal with" said Ron Gulla, a rural resident who lives about 30 miles from Pittsburgh. Mr. Gulla has been speaking at meetings throughout the region, helping landowners make informed decisions before leasing their land to natural gas companies. "This is the defense of your life and property, we're fighting for our f#cking lives!"

The Marcellus Shale is a fossil fuel rich rock bed that ranges from the middle of Ohio east to the Catskill Mountains, from upstate New York down south through Kentucky. Drilling waste water may contaminate the drinking water of New York City, Washington D.C., and Philadelphia. Officials in New York City have been pushing legislation to ban natural gas drilling in the Catskill Mountains, which feed the city's drinking water reservoirs. Washington DC gets its drinking water from the Potomac River, whose tributaries are threatened by the toxic liquid wastes produced during natural gas drilling.

The oil and gas industry calls the Marcellus Shale an "unconventional natural gas source"; mining this area was uneconomical until this decade, where the price of oil has been skyrocketing. The Marcellus Shale is the 3rd largest natural gas field in the world, expected to generate enough natural gas for 2 to 10 years of US consumption. The process is being advertised as a local clean energy source, bringing in jobs and economic growth. The mining of the Marcellus Shale is projected to continue to pollute the soil, streams and aquifers in the Northeastern United States for 5 to 30 years. After the Marcellus is depleted, oil companies will work on the Utica Shale, which rests thousands of feet beneath the Marcellus.

Natural gas drilling waste water -- which includes radium, uranium, mercury, and lead -- is suspected to be responsible for the deaths of the 161 species of life which were found killed along 38 miles of Dunkard Creek in Pennsylvania.(2) The Natural Resource Defense Council has reported that livestock have been dying after drinking drilling waste water.(3) The Oil and Natural Gas Industries are officially exempt from the Safe Drinking Water Act, the Clean Air Act, the Clean Water Act, the Emergency Planning and Community Right to Know Act, the Natural Resource Recovery Act and other federal regulations.(4) These exemptions have made the federal government complicit in Coloradan Laura Amos's adrenal cancer(5), and Pennsylvanian Pat Farnelli and her children's violent stomach pains and diarrhea.(6)(7) Benzene and radioactive waste from a WWII military dumping site are suspected of having caused a childhood cancer cluster in Clyde, Ohio, torturing 20 children(8); these toxic contaminants are also produced as wastes during natural gas production(9) and stored in open pits on drilling sites.(10)

At the center of the struggle is the new process of natural gas drilling called horizontal hydrofracking, also known as "fracking."

Natural gas production in the Marcellus Shale involve two stages which each introduce toxic contaminants into our environment. Producers must first drill the well and then they "frack" the well. The first process, drilling, dredges uranium, radium, mercury, and lead laden shale rocks to the surface (11) to make way for a pipe used in the fracking process. These toxic shale materials are stored in open pits on the site for long periods of time, and the liquid wastes are eventually brought to municipal water treatment plants for filtration. Municipal water treatment plants are already so overburdened and unable to filter out toxins from our drinking water that on September 12, the New York Times reported "the nation’s water does not meet public health goals, and enforcement of water pollution laws is unacceptably low."(12)

The second stage of natural gas production, the "fracking" process, is very expensive: each fracking job requires 2-9 million of gallons of water to be extracted from local water sources and creates 1-4 million gallons of toxic liquid waste, which must be brought to a hazardous waste dump or extensively filtered before entering the public watersheds.(13) This amount of waste is generated numerous times per well, as each well can be fracked up to 10 times. The Pennsylvania Department of Environmental Protection allows 800,000 gallons to be taken from Cross Creek Lake every day; Range Resources, a Texas based oil and natural gas company, is the recipient of that permit.(14) This wednesday, Sept. 30 at 7pm, a public hearing in Williamsport , PA will be held for a waste water treatment facility requesting permission to pump 400,000 gallons of minimally treated drilling waste water *every day* into the Susquehanna River.(15)

Throughout the nation State Parks and Public Schools have leased their mineral rights to oil and gas companies in an attempt to balance budgets.(16) And this school year, kids at Elk Lake School in Dimock, PA may get to play in radioactive sludge during recess.(17)

Residents throughout the nation have complained that their wells, soils and streams have been contaminated with the heavy metals and radioactive tailings dredged up from the shale along with the gas.(18) The numerous chemicals used in the fracking process are also a concern. As the natural gas is pumped away from the site through pipelines, the hazardous fracking waste fluids are usually stored on site in open pits for long periods of time.(19) These open pits are often only 100 ft from a persons home or a creek or critical migration corridor, and are sometimes surrounded by a flimsy 3 foot high plastic fencing in a feeble attempt to protect the kids, dogs, livestock, wildlife, and downwind neighbors from the toxins.(20)

Some citizens have been concerned that workers may be poking holes into the plastic sheets that line the bottom of the liquid waste pits, allowing the liquids to drain into the soil and saving the company the expense of disposal at expensive hazardous waste facilities. A landowner told Indymedia that he has watched the levels in waste water pits steadily decrease after they were filled up. In Garfield County, Colorado, a resident videotaped bulldozers burying liquid waste pits with soil, the videotaper reported that the natural gas company Encana owns that drilling pad.(21) Hundreds of miles north of this contamination site, two of Encana's natural gas pipelines were bombed, distraught Canadian citizens are suspected to be responsible.(22)

Recently, residents in Dimock, Pennsylvania were able to voice enough concern to get the Pennsylvania Department of Environmental Protection (DEP) to temporarily stop fracking activities by Cabot, a natural gas producing company that has been spilling toxins into wetlands and a creek.(23) Cabot's fracking activities will be halted for two weeks, but the company may still drill and bore holes for pipelines through wetland areas. Cabot's drilling activities underneath wetlands has been a source of contention for citizen groups due to documented footage of bentonite spills along Cabot's Cranberry Pipeline, a pipeline which currently is being horizontally drilled underneath a wetlands area in Susquehanna County.(24)

Pennsylvania DEP's oil and gas investigation unit is understaffed, and individual citizens are having to monitor drilling activities. Craig Lobins, DEP Northwest Regional Manager for the Oil and Gas Program recently explained to citizens at a meeting in Forest City, PA how the department is unable to fully monitor all drilling sites:

"Lets be realistic about it, they drill 24-7, and I don't think anyone expects someone to stand on a rig 24 hours a day 7 days a week." Mr.Lobins explained to the crowd of over 100 concerned citizens who attended the meeting hosted by the group R.E.S.C.U.E. " And if we did expect them to stand there all day, imagine how expensive that would be."(25)

At a meeting of the Oil and Gas Advisory Technical Board on October 30 of 2008, official notes state that Mr. Lobins "expressed the need for more Oil and Gas Inspectors. He said even if there is no projected increase in permitting, DEP is still understaffed in this area."(26)

But, when Mr. Lobins was asked at the recent Forest City meeting on Sept 16, if he supported a moratorium on drilling until the DEP had enough staff and local oversight of drilling activity, he responded "No." Instead of hiring more investigators, Lobins told the citizens at the Forest City meeting that local residents should be "the eyes of the DEP". Citizens who followed Mr. Lobins suggestion were subsequently told by agents of the DEP that they can't be trespassing onto gas leased land to monitor these sites for illegal activity.

Joanne Fiorito, acting as the eyes of the DEP, recently discovered a waste spill at a drilling site just off RT 29 and upon reporting the spill was warned not to trespass. "If the DEP can't monitor these sites on their own," said Ms. Joanne Fiorito "and then the DEP tells us that we cannot trespass after we found a spill on the Grimsley well pad site that wasn't reported to the DEP by Cabot, well then, where does this leave the citizens of PA who are dependent on the DEP doing its job? It has gotten to the point where I and others will have to do it ourselves, and I personally don't care if they arrest me for civil disobedience, because this land, air and water is what keeps us all alive."

Exxon Mobil pays fine in case tied to bird deaths

Exxon Mobil Corp. has agreed to pay $600,000 in fines and community service payments under a deal with the federal government concerning violations of a federal migratory bird law in five states including Texas, the Justice Department said today.


On Wednesday, the Irving-based oil giant pleaded guilty in a federal district court in Denver to five misdemeanor charges of breaking the U.S. Migratory Bird Treaty Act.

Exxon Mobil was accused of killing about 85 birds including water fowl and hawks in Colorado, Wyoming, Oklahoma, Texas and Kansas.

The birds died after exposure to hydrocarbons in open natural gas well pits and wastewater storage facilities at company sites in each state, said John Cruden, acting assistant U.S. attorney general, in a conference call this morning.
